  12   Amsterdam, the Netherlands ("BF") and you (either an individual or a
  13   legal entity) ("You") with respect to the software product which this
  14   License Agreement accompanies (the "Software").

  16   By installing, copying or otherwise using the Software, You agree to be
  17   bound by the terms of this License Agreement. If You do not agree to the
  18   terms of this License Agreement do not install or use the Software.

  20   1. Grant of License

  22   Subject to the provisions of this License Agreement, BF grants You a
  23   limited, non-exclusive, personal, non-sublicenseable, non-transferable
  24   license to use the Software at any computer You own or use.
  25   Artwork you create with the Software - whether it is images, movies,
  26   scripts, exported 3d files or the .blend files themselves - is your sole
  27   property, and can be licensed or sold under any conditions you prefer.

  29   2. Permitted copying and electronic distribution of Software

  31   You are hereby granted permission to copy and distribute the Software
  32   without written agreement from BF. This entire License Agreement, and
  33   the GPL-license.txt must appear in and/or accompany all copies of the
  34   Software. The source code distribution, which can be found at the same
  35   location where you obtained the Software, has to accompany all copies
  36   of the Software as well.

  38   3. Disclaimer of Warranties

  40   BF provides you with the Software "as is" and with all faults. BF
  41   explicitly disclaims all warranties and guarantees and does not make any
  42   representations with respect to the Software, whether express, implied,
  43   or statutory, including, but not limited to any (if any) warranties of
  44   or related to: fitness for a particular purpose, title,
  45   non-infringement, lack of viruses, accuracy or completeness of
  46   responses, results, lack of negligence or lack of workmanlike effort,
  47   and correspondence to description. The entire risk arising out of use or
  48   performance of the Software remains with You.

  50   4. Limitation of Liability

  52   In no event shall BF or its employees, agents or suppliers be liable
  53   for any direct, indirect, consequential, incidental, special, punitive,
  54   or other damages whatsoever (including, without limitation, damages for
  55   loss of business profits, business interruption, loss of business
  56   information, claims of third parties, damages as a result of injury to
  57   any person, or any other loss) arising out of or in connection with the
  58   license granted under this License Agreement or the use of or inability
  59   to use the Software, even if BF has been advised of the possibility of
  60   such damages.

  62   5. User warning and indemnification

  64   WARNING: use of the Software and use of any works that are (partially)
  65   created with the Software (the "Works") may cause physical or
  66   psychological reactions from You or from third parties, which may result
  67   in damages, injuries, losses and/or other negative consequences. You
  68   acknowledge that BF can not be held liable for any such damages,
  69   injuries, losses and/or other negative consequences. You acknowledge
  70   that it is your obligation to investigate, prevent and/or minimize such
  71   reactions prior to having third parties use the Works.

  73   You shall indemnify and hold harmless BF from and against all actions,
  74   claims, demands, proceedings, losses, damages, costs, charges and
  75   expenses, including but not limited to legal fees and expenses, arising
  76   out of or in connection with (i) the use of the Software by You and (ii)
  77   the use of any Works created with the Software by You or any third
  78   parties.

  80   6. Term and Termination

  82   This License Agreement and the license granted hereunder is effective
  83   until terminated. This License Agreement shall terminate automatically
  84   and forthwith if You fail to comply with the terms of this License
  85   Agreement. Upon termination, You shall cease the use of the Software,
  86   remove the Software from (the memory of) your computer and destroy all
  87   copies of the Software.

  89   7. Entire Agreement

  91   This License Agreement is the entire agreement between BF and You in
  92   respect of the subject matter of the License Agreement. This License
  93   Agreement supersedes all prior written or oral agreements, proposals or
  94   understandings, and any other communications between BF and You
  95   relating to the subject matter of this License Agreement.

  97   8. Enforceability

  99   If any provision of this License Agreement is held to be unenforceable
 100   by a court of competent jurisdiction for any reason, such provision
 101   shall be adapted or amended only to the extent necessary to make it
 102   enforceable, and the remainder of the License Agreement shall remain in
 103   effect.

 105   9. Governing law and disputes

 107   This License Agreement and all disputes arising from it will be governed
 108   by the laws of The Netherlands. All disputes arising in connection with
 109   this Agreement that cannot be settled amicably shall be brought before
 110   the competent court in Amsterdam, the Netherlands, to which jurisdiction
 111   BF and You hereby irrevocably consent.
