  13   legal entity) ("You") with respect to the software product which this

  16   By installing, copying or otherwise using the Software, You agree to be
  17   bound by the terms of this License Agreement. If You do not agree to the
  18   terms of this License Agreement do not install or use the Software.

  22   Subject to the provisions of this License Agreement, BF grants You a
  23   limited, non-exclusive, personal, non-sublicenseable, non-transferable
  24   license to use the Software at any computer You own or use.

  26   2. Permitted copying and electronic distribution of Software

  28   You are hereby granted permission to copy and distribute the Software
  29   without written agreement from BF. This entire License Agreement, and
  30   the GPL-license.txt must appear in and/or accompany all copies of the
  31   Software. The source code distribution, which can be found at the same
  32   location where you obtained the Software, has to accompany all copies
  33   of the Software as well.

  35   3. Disclaimer of Warranties

  37   BF provides you with the Software "as is" and with all faults. BF
  38   explicitly disclaims all warranties and guarantees and does not make any
  39   representations with respect to the Software, whether express, implied,
  40   or statutory, including, but not limited to any (if any) warranties of
  41   or related to: fitness for a particular purpose, title,
  42   non-infringement, lack of viruses, accuracy or completeness of
  43   responses, results, lack of negligence or lack of workmanlike effort,
  44   and correspondence to description. The entire risk arising out of use or
  45   performance of the Software remains with You.

  47   4. Limitation of Liability

  49   In no event shall BF or its employees, agents or suppliers be liable
  50   for any direct, indirect, consequential, incidental, special, punitive,
  51   or other damages whatsoever (including, without limitation, damages for
  52   loss of business profits, business interruption, loss of business
  53   information, claims of third parties, damages as a result of injury to
  54   any person, or any other loss) arising out of or in connection with the
  55   license granted under this License Agreement or the use of or inability
  56   to use the Software, even if VF has been advised of the possibility of
  57   such damages.

  59   5. User warning and indemnification

  61   WARNING: use of the Software and use of any works that are (partially)
  62   created with the Software (the "Works") may cause physical or
  63   psychological reactions from You or from third parties, which may result
  64   in damages, injuries, losses and/or other negative consequences. You
  65   acknowledge that BF can not be held liable for any such damages,
  66   injuries, losses and/or other negative consequences. You acknowledge
  67   that it is your obligation to investigate, prevent and/or minimize such
  68   reactions prior to having third parties use the Works.

  70   You shall indemnify and hold harmless BF from and against all actions,
  71   claims, demands, proceedings, losses, damages, costs, charges and
  72   expenses, including but not limited to legal fees and expenses, arising
  73   out of or in connection with (i) the use of the Software by You and (ii)
  74   the use of any Works created with the Software by You or any third
  75   parties.

  77   6. Term and Termination

  79   This License Agreement and the license granted hereunder is effective
  80   until terminated. This License Agreement shall terminate automatically
  81   and forthwith if You fail to comply with the terms of this License
  82   Agreement. Upon termination, You shall cease the use of the Software,
  83   remove the Software from (the memory of) your computer and destroy all
  84   copies of the Software.

  86   7. Entire Agreement

  88   This License Agreement is the entire agreement between BF and You in
  89   respect of the subject matter of the License Agreement. This License
  90   Agreement supersedes all prior written or oral agreements, proposals or
  91   understandings, and any other communications between BF and You
  92   relating to the subject matter of this License Agreement.

  94   8. Enforceability

  96   If any provision of this License Agreement is held to be unenforceable
  97   by a court of competent jurisdiction for any reason, such provision
  98   shall be adapted or amended only to the extent necessary to make it
  99   enforceable, and the remainder of the License Agreement shall remain in
 100   effect.

 102   9. Governing law and disputes

 104   This License Agreement and all disputes arising from it will be governed
 105   by the laws of The Netherlands. All disputes arising in connection with
 106   this Agreement that cannot be settled amicably shall be brought before
 107   the competent court in Amsterdam, the Netherlands, to which jurisdiction
 108   BF and You hereby irrevocably consent.
